NCCIA Calls Asad Ali Toor for Inquiry Under PECA Section 26A

The National Cyber Crime Investigation Agency (NCCIA) has issued a notice to journalist Asad Ali Toor, directing him to appear before the agency as part of an inquiry into the alleged dissemination of false information under the Prevention of Electronic Crimes Act (PECA) 2016.

According to the notice, the NCCIA is conducting the inquiry under Section 26A of the Prevention of Electronic Crimes Act (PECA), which addresses the alleged dissemination, transmission, or public display of false or fake information. The agency issued the notice under Section 160 of the Code of Criminal Procedure (CrPC), and Toor also shared it on his X account.

The NCCIA stated that it registered the complaint as “Through State” on July 28. The agency has asked the journalist to appear in person at the NCCIA Cybercrime Reporting Centre on Saturday to present his version during the inquiry.

The notice also warns that if Toor fails to appear without a lawful reason, the inquiry may proceed ex parte, meaning it could continue in his absence. It further states that failing to comply with the notice may result in action under Section 174 of the Pakistan Penal Code (PPC), 1860.

National Press Club criticizes the notice

The National Press Club (NPC) strongly criticized the NCCIA’s decision to summon the journalist. In a statement, the NPC described the notice as an attempt that could put pressure on press freedom and freedom of expression.

The organization said the Constitution guarantees citizens, especially journalists, the right to freely express their views and carry out their professional responsibilities.

The NPC added that using legal measures against journalists for performing their duties or expressing critical opinions does not reflect the principles of a democratic society.

Call to protect journalists’ rights

The National Press Club urged state institutions to avoid placing unnecessary pressure on journalists and to act in accordance with the Constitution, the law, and fundamental human rights.

The organization emphasized that a free, responsible, and secure press plays an important role in strengthening democracy. It called for the immediate withdrawal of the notice issued to Asad Ali Toor and urged authorities to fully respect the constitutional and legal rights of journalists.

The NPC also warned against taking actions that could limit press freedom or create a sense of insecurity within the journalistic community.

The NCCIA has not publicly shared further details about the allegations beyond the information contained in the notice, and the inquiry remains ongoing.
